These Terms of Service ("Terms") govern your access to and use of onzeselectie.com (the "Website") and any purchases made through the Website.

The Website is operated by Onze Selectie ("we", "us", "our").

By accessing the Website, using our services, or placing an order, you agree to be bound by these Terms, together with our Privacy Policy, Return & Refund Policy, and any other policies published on the Website.

Nothing in these Terms excludes or limits mandatory consumer rights that cannot legally be excluded or limited.

1. Business Information

Website: onzeselectie.com

Please note that the business address above is not our product return address.

Customers wishing to return a product must follow our Return & Refund Policy and use the designated return address provided there or by our customer service team.

2. Eligibility

By using the Website or placing an order, you confirm that you have the legal capacity to enter into a binding agreement or that you are using the Website with the authorization of a parent or legal guardian where required by applicable law.

You agree to provide accurate, current, and complete information when placing an order.

We reserve the right to refuse service, cancel orders, restrict access, or request additional information where reasonably necessary for fraud prevention, security, legal compliance, or protection of our business.

3. Products and Product Information

We make reasonable efforts to display product descriptions, photographs, specifications, colors, dimensions, features, and other information accurately.

However, the appearance of products may vary depending on factors such as:

  • Screen and device settings;

  • Lighting;

  • Manufacturing batches;

  • Packaging updates;

  • Minor production variations; and

  • Product improvements or modifications.

Minor differences that do not materially affect the essential characteristics or intended use of a product may occur.

Nothing in this section limits any mandatory rights relating to goods that are defective, materially different from their description, or otherwise non-conforming under applicable law.

4. Prices

Prices displayed on the Website may be changed at any time before an order is placed.

The price applicable to your purchase is generally the price displayed at checkout when the order is submitted, subject to correction of obvious errors where permitted by applicable law.

We reserve the right to correct pricing, typographical, technical, or promotional errors.

If an obvious pricing error affects an order, we may contact you before fulfillment and, where legally permitted, offer you the opportunity to purchase at the correct price or cancel the affected order for a refund.

5. Orders

Submitting an order does not necessarily mean that we are required to accept it.

After an order is placed, you may receive an electronic confirmation acknowledging receipt of your order.

We reserve the right, where reasonably justified and permitted by law, to refuse or cancel an order, including where:

  • A product is unavailable;

  • Payment cannot be authorized;

  • Information provided is incomplete or incorrect;

  • We reasonably suspect fraud or unauthorized activity;

  • There is an obvious pricing or technical error;

  • Delivery to the requested destination is unavailable;

  • The order violates these Terms; or

  • Acceptance or fulfillment would violate applicable law.

If we cancel an order after receiving payment and no amount is otherwise lawfully due, the applicable amount will be refunded.

6. Payment

Customers must provide valid and accurate payment information.

By submitting payment information, you represent that you are authorized to use the selected payment method.

Payments may be processed by independent third-party payment providers.

We may use fraud prevention systems and may request additional verification before accepting or fulfilling an order.

We reserve the right to delay or cancel an order where payment authorization or identity verification cannot reasonably be completed.

7. Shipping and Delivery

Products may be shipped from warehouses, suppliers, or fulfillment facilities located in countries different from the customer's country of residence.

Delivery estimates shown on the Website are estimates unless expressly stated otherwise or unless applicable law provides otherwise.

Actual delivery times may be affected by circumstances outside our reasonable control, including:

  • Carrier delays;

  • Customs procedures;

  • Local postal operations;

  • Incorrect or incomplete delivery information;

  • Severe weather;

  • Public holidays;

  • Transportation disruptions;

  • High-volume periods;

  • Customs inspections; and

  • Other logistical events outside our reasonable control.

We will nevertheless comply with mandatory delivery obligations imposed by applicable consumer law.

8. Customer Responsibility for Delivery Information

Customers are responsible for providing accurate and complete delivery information.

This includes the recipient's:

  • Full name;

  • Street address;

  • Apartment or unit number where applicable;

  • Postal code;

  • City;

  • Country;

  • Telephone number; and

  • Other information reasonably necessary for delivery.

Customers should contact us as soon as possible if they discover an error.

We cannot guarantee that an address can be modified after an order has entered processing or fulfillment.

Where additional costs arise solely because a customer supplied incorrect or incomplete information, such costs may be charged or deducted where permitted by applicable law.

9. Failed, Refused, or Uncollected Deliveries

Customers are responsible for reasonably cooperating with the carrier to receive their order.

If a shipment cannot be delivered because of circumstances attributable to the customer, including an incorrect address or failure to collect the shipment, additional shipping or handling costs may apply where permitted by law.

Simply refusing a delivery does not necessarily constitute proper notification of withdrawal.

Customers wishing to exercise a statutory right of withdrawal should follow the procedure described in our Return & Refund Policy.

10. Returns and Refunds

Our Return & Refund Policy forms part of these Terms.

Eligible consumers may have a statutory right to withdraw from an online purchase within 14 days after receiving the goods, subject to applicable conditions and statutory exceptions.

For standard change-of-mind returns, the customer is responsible for the direct cost of returning the goods where permitted by applicable law and where the customer has been properly informed of this obligation.

Returns must be sent to the designated return facility in accordance with our Return & Refund Policy.

Our Wyoming business address is not a return facility.

Please contact support@onzeselectie.com before returning a product.

11. Condition of Returned Products

Customers may inspect products to the extent reasonably necessary to establish their nature, characteristics, and functioning.

Customers may be responsible for any diminished value resulting from handling beyond what is reasonably necessary for that purpose, to the extent permitted by applicable law.

We therefore recommend returning products with all components, accessories, manuals, labels, inserts, protective materials, and original packaging where reasonably possible.

Further conditions are described in our Return & Refund Policy.

12. Defective, Damaged, or Incorrect Products

If you receive a product that is defective, damaged upon delivery, incorrect, or otherwise non-conforming, please contact:

support@onzeselectie.com

Please provide your order number and reasonable evidence of the issue, such as photographs where appropriate.

We may request additional information reasonably necessary to investigate the claim.

Customers should not independently dispose of or return a disputed product before receiving instructions from customer service unless otherwise permitted or required by applicable law.

Nothing in these Terms limits mandatory legal rights relating to defective or non-conforming goods.

13. Promotions and Discount Codes

Promotional offers, discount codes, gifts, and special offers may be subject to additional conditions.

Unless expressly stated otherwise:

  • Promotional codes cannot be exchanged for cash;

  • Only one promotional code may be used per order;

  • Promotions may have expiration dates;

  • Promotions may apply only to selected products or customers; and

  • Promotions may not be combined.

We may cancel or refuse promotional benefits obtained through fraud, manipulation, technical errors, multiple-account abuse, or other misuse.

14. Website Availability

We aim to keep the Website available and functioning correctly but do not guarantee uninterrupted or error-free access.

We may temporarily restrict, suspend, update, or modify parts of the Website for maintenance, security, technical, operational, or legal reasons.

We are not responsible for interruptions outside our reasonable control, subject to any liability that cannot legally be excluded.

15. Intellectual Property

Unless otherwise stated, the Website and its content, including its:

  • Text;

  • Graphics;

  • Logos;

  • Designs;

  • Product presentation;

  • Images owned or licensed by us;

  • Videos;

  • Layout;

  • Software;

  • Branding; and

  • Other original materials

are owned by us or used under appropriate rights or licenses and are protected by applicable intellectual property laws.

You may use the Website only for personal and lawful purposes.

You may not reproduce, republish, distribute, systematically extract, commercially exploit, or create derivative works from protected Website content without authorization, except where permitted by applicable law.

16. Prohibited Uses

You may not use the Website:

  • For unlawful or fraudulent purposes;

  • To impersonate another person;

  • To submit false payment or delivery information;

  • To interfere with Website security;

  • To introduce malware or malicious code;

  • To attempt unauthorized access to our systems;

  • To conduct automated scraping that materially interferes with our services;

  • To abuse promotions, refunds, chargebacks, or customer service procedures;

  • To infringe intellectual property or privacy rights; or

  • In any manner that violates applicable law.

We may restrict access or cancel affected transactions where we reasonably identify prohibited conduct, subject to applicable law.

17. Fraud and Chargeback Abuse

We reserve the right to investigate suspected fraudulent transactions, refund abuse, unauthorized payment claims, or other misuse of our services.

Customers should contact us at support@onzeselectie.com if they believe there is a legitimate problem with an order.

Nothing in this section prevents a customer from exercising any lawful right to dispute a transaction with a bank, card issuer, payment provider, court, regulator, or consumer protection authority.

Where we reasonably believe a claim is fraudulent or abusive, we may provide relevant transaction, delivery, communication, and order records to payment providers, financial institutions, fraud prevention providers, professional advisers, or competent authorities where permitted by law.

18. Third-Party Services

Our Website may rely on third-party providers for services such as:

  • Payment processing;

  • Website hosting;

  • Order management;

  • Fulfillment;

  • Shipping;

  • Analytics;

  • Advertising;

  • Communications; and

  • Fraud prevention.

We are not responsible for independent third-party services to the extent that their acts or omissions are outside our reasonable control, except where applicable law makes us responsible.

19. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, or consequential losses that were not reasonably foreseeable or that result from circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, nothing in these Terms excludes or limits mandatory consumer rights or liability that cannot legally be excluded.

20. Force Majeure

To the extent permitted by applicable law, we will not be responsible for delays or failures caused by events outside our reasonable control.

Such events may include natural disasters, severe weather, war, civil unrest, governmental action, epidemics, transportation disruption, strikes, carrier disruption, telecommunications failures, customs delays, or widespread technical failures.

This provision does not remove any refund, delivery, or other rights that consumers are mandatorily entitled to under applicable law.

21. Privacy

Personal information collected through the Website is processed in accordance with our Privacy Policy.

By using the Website, you acknowledge that personal information may be processed by service providers necessary to operate the Website, process payments, fulfill orders, provide customer support, prevent fraud, and perform other legitimate business activities.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, business practices, technology, or applicable law.

The version applicable to an order will generally be the version in effect when that order was placed, except where applicable law requires otherwise.

The "Last updated" date at the top indicates when these Terms were most recently revised.

23. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where legally possible.

The remaining provisions will continue to apply.

24. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

Any waiver will apply only to the specific circumstances for which it was given.

25. Governing Law and Consumer Rights

These Terms and our contractual relationship may be governed by the laws applicable to our business, subject always to mandatory consumer protection rules.

If you are a consumer residing in the European Union, European Economic Area, United Kingdom, or another jurisdiction providing mandatory consumer protections, nothing in these Terms deprives you of protections that cannot be waived under the laws applicable to you.

Any provision concerning jurisdiction or applicable law will apply only to the extent permitted by mandatory consumer law.

26. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, and other policies expressly incorporated into them, constitute the terms governing your use of our Website and purchases from us, subject to mandatory applicable law.
